Isn't it be illegal for you to make games sold on virtual console on the e-shop playable on this SB game? Because we would be getting to play them all we want for free, and Nintendo is selling some of them on the e-shop, so isn't this considered piracy? Mostly because a lot of websites that you can download roms at have been sued by Nintendo and only have roms for games that never got a seal of approval from Nintendo.

Honestly, the entire Virtual Console thing is a sham. Nintendo literally pirates its own games from these sites for use on the VC(See:Super Mario Bros rom). Nintendo has always held a very, very hostile approach to emulation, legal or not, and they keep stepping over the boundaries very quickly. Besides, this is competition to their propitiatory VC, and if Nintendo snuffed this one out, I'm pretty sure competitive laws would kick into play to prevent the competition from getting snuffed out.

It is indeed a sham, a Captain Sham, and the sea ish his life. Actually it's a rather large lake.

We're talking about Nintendo here. Nintendo doesn't care what is legal or not, if it emulates, looks like, plays like, or even has the hint of a resemblance to their games, they will sue. This is why so many fan games get screwed.

Emulation is legal. Emulation is legal. (did I mention Emulation is legal?) If it wasn't, we wouldn't have all these emulators and Nintendo would be constantly suing libretro, citra, and other devs. Illegal ROM downloading IS illegal. Emulators don't contain any Nintendo copyrights. (aside from the console name, but that's really REALLY easy to sidestep) ROMs contain the copyrighted characters, settings, code, music, etc. Nintendo will only strike if they see ORIGINAL GAMES (i.e. not ROM dumps of their own games) with THEIR CHARACTERS. They will only take down the emulator if it contains gosh dang DOnkey kong.gb.

So it looks like Nintendo's being a hypocrite about all the nostalgia, including emulation and the history of gaming. They even ruined and killed nostalgia instantly with Super Smash Bros. Ultimate for the Nintendo Switch. 😖😯 👻 They (and Konami) even killed Bomberman entirely!!! 😰😥

So, the grand take-away is that... Atleast it's not Sony we're dealing with.

...Did you read what I wrote? There's a history of Nintendo not taking down emulators that emulate their hardware. When you say "Nintendo doesn't care", you should maybe attach a few examples. All you did in that post was say a thing and not back it up, then you acted like your argument was rock solid. Nintendo takes down ROMs and FAN PROJECTS THAT USE THEIR IPs. They don't take down emulators because without a ROM an emulator is useless. If Nintendo cared about people reproducing their hardware, Nintendo would've probably already murdered Analogue for reverse engineering all their hardware. Yet... Analogue still sells their hardware clones. The only thing they aren't using is the name. Heck, even modern emulators recieve money (via Patreon) for recreating 3DSes and Wii Us almost flawlessly.

The main reason Sony sued Bleem is because it was a COMMERCIAL emulator.
Sony would've sued even if it hadn't been commerical, it was because of copyrighted hardware(and more or less also software, this is a continuing trend to this day that you need to get your Sony BIOS from your own console even if you literally do not have the monetary means to do so.) Sony hates its fanbase, this has been pretty evident for years now, with the last hopes of it actually liking its fanbase dying with the new PSN. This part is no longer really relevant but I'll keep it here for the sake of historical context.

That's Bleem, a Sony PS1 emulator, not an emulator for any Nintendo consoles. I was referring to an article I had seen once where Nintendo had sued someone who had made an emulator for the (at the time relevant) Wii U.

Actually, Sony sued because both of the rights on the design of various PSX chips (Emotion Engine, etc) and the commercialization of it. If Nintendo used a custom, own chip for a console, they would too. It's not that they hate their fanbase, that's just... stupid.

To (hopefully) end this argument... Emulators are legal. Emulators are legal. Emulators are legal. Nintendo never says they aren't legal, they emphasize that ROMs aren't legal. To be fair to people who believe emulators are illegal, the way Nintendo words their statements makes it sound like emulators are illegal. To confirm, however, emulators are NOT illegal unless they contain copyrighted material, which most do not.
